HB1055 Infant Eye Care Bill Text

The Bill mandates an infant eye dilation exam before babies leave the hospital; and at the 6-8 week and 6-9 month well-baby exams. It is a simple test that would cost 10¢ and take 10 seconds of the doctors time to accomplish. The text of the bill follows:

4 |      born in hospitals in the state; exempting this requirement |
| |
5 |      from s. 383.07, F.S.; reenacting s. 383.07, F.S., relating to |
| |
6 |      to a penalty; revising applicability; amending ss. |
| |
7 |      627.6416 and 641.31, F.S.; providing that coverage for |
| |
8 |      children under health insurance policies and health |
| |
9 |      maintenance organization contracts must include certain |
| |
10 |      eye examination for infants and children; providing an |
| |
11 |      effective date. |

| |
13 | Be it Enacted by the Legislature of the State of Florida: |
| |
14 | |
| |
15 |      Section 1.  Section 383.04, Florida Statutes, is amended to |
| |
16 | read: |
| |
17 |      383.04  Prophylactic required for eyes of infants.--Every |
| |
18 | physician, midwife, or other person in attendance at the birth |
| |
19 | of a child in the state is required to instill or have instilled |
| |
20 | into the eyes of the baby within one hour after birth an effective |
| |
21 | prophylactic recommended by the Committee of Infectious Diseases |
| |
22 | of the American Academy of Pediatrics for the prevention of |
| |
23 | neonatal opthalmia. In addition, every baby born in the hospital |
| |
24 | in the state shall, before being discharged from the hospital, |
| |
25 | receive an eye examination using an ophthalmoscope and dilation |
| |
26 | of the pupils for detection of pediatric congenital, ocular, and |
| |
27 | developmental abnormalities; however, this requirement is not |
| |
28 | subject to s. 383.07. This section does not apply to cases where |
| |
29 | the parents file with the physician, midwife, or other person in |
| |
30 | attendance of a birth of a child written objections on account |
| |
31 | of religious beliefs contrary to the use of drugs. In such case |
| |
32 | the physician, midwife, of other person in attendance shall |
| |
33 | maintain a record that such measures were or were not employed |
| |
34 | and attach thereto any written objection. |
| |
35 |      Section 2.  For the purpose of incorporating the amendment |
| |
36 | to section 383.04, Florida Statutes, in a reference thereto, |
| |
37 | section 383.07, Florida Statutes, is reenacted to read: |
| |
38 |      383.07  Penalty for violation.--Any person who fails to |
| |
39 | comply with the provisions of ss. 383.04-383.06 shall be guilty |
| |
40 | of a misdemeanor of the second degree, punishable as provided in |
| |
41 | s. 775.083. |
| |
42 |      Section 3.  Paragraph (a) of subsection (2) of section |
| |
43 | 627.6416, Florida Statutes, is amended to read: |
| |
44 |      627.6416  Coverage for child health supervision services.-- |
| |
45 |      (2)  As used in the subsection, the term "child health |
| |
46 | supervision services" means physician-delivered or physician- |
| |
47 | supervised services that include, at a minimum, services |
| |
48 | delivered at the intervals and scope stated in this section. |
| |
49 |      (a)  Child health supervision services must include |
| |
50 | periodic visits which shall include a history, a physical |
| |
51 | examination, and developmental assessment and anticipatory |
| |
52 | guidance, and appropriate immunizations and laboratory tests, |
| |
53 | and eye examinations at birth, at 6 to 8 weeks of age, and at 6 |
| |
54 | to 9 months of age, using an ophthalmoscope and dilation of the |
| |
55 | pupils for detection of pediatric congenital, ocular, and |
| |
56 | developmental abnormalities. Such services and periodic visits |
| |
57 | shall be provided in accordance with prevailing medical |
| |
58 | standards consistent with the Recommendations for Preventive |
| |
59 | Pediatrics Health Care of the American Academy of Pediatrics. |
| |
60 | Section 4.  Paragraph (b) of subsection (30) of section |
| |
61 | 641.31, Florida Statutes, is amended to read: |
| |
62 |      641.31  Health maintenance contracts.-- |
| |

| |
64 |      (b)  As used in the subsection, the term "child health |
| |
65 | supervision services" means physician-delivered or physician- |
| |
66 | supervised service that include, at a minimum, services |
| |
67 | delivered at the intervals and scope stated in this subsection. |
| |
68 |      1.  Child health supervision services must include periodic |
| |
69 | visits that will include a history, a physical examination, a |
| |
70 | developmental assessment and anticipatory guidance, and |
| |
71 | appropriate immunizations and laboratory tests, and eye |
| |
72 | examinations at birth, at 6 to 8 weeks of age, and at 6 to 9 |
| |
73 | months of age, using an ophthalmoscope and dilation of the |
| |
74 | pupils for detection of pediatric congenital, ocular, and |
| |
75 | developmental abnormalities. Such services and periodic visits |
| |
76 | shall be provided in accordance with prevailing medical |
| |
77 | standards consistent with the Recommendations for Preventive |
| |
78 | Pediatric Health Care of the American Academy of Pediatrics. |
| |
79 |      2.  Minimum visits may be limited to one visit payable to |
| |
80 | one provider for all of the services provided at each visit. |
| |

82 |      Section 5.  This act shall take effect July 1, 2005. |
